We are committed to safeguarding your privacy in compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), and other relevant privacy regulations.
1.2. Scope and Applicability
This Policy applies to all users of the TrekGuider Marketplace, including buyers, sellers, content creators, and visitors to our website. It describes our practices regarding the collection, use, and disclosure of your personal data, as well as your rights concerning that data. This Policy forms an integral part of our overall Terms and Conditions and is closely linked to our Cookie Policy and other privacy-related documents.
2. Types of Data Collected
2.1. Personal Data
We collect various types of personal data when you use the Marketplace, including:

· Account Information: This includes data related to your Marketplace account, such as your username, password, profile details, profile picture, biography, seller verification documents (if you are a seller), communication preferences, and account settings.
· Technical Data: This includes information about your device and how you interact with the Marketplace, such as your IP address, browser type, device information (device model, operating system version), operating system, browser language, time zone, geographic location data (if you consent to location tracking), page views, and cookie data.

· Social Login Data: If you choose to register or log in to the Marketplace using social networking credentials (e.g., Google, X (Twitter), Facebook), we may collect relevant personal data from your social media profile, such as your name, email address, profile picture, and public profile information, as authorized by your privacy settings on those platforms and as permitted by their respective terms of service and privacy policies. This data is collected to streamline the account creation and login process and to personalize your user experience on the Marketplace.
2.2. Data Collected via Cookies and Similar Technologies
In addition to the personal data outlined above, we also collect data through cookies and similar tracking technologies. For more details on how cookies are used, please review our Cookie Policy.
2.3. Data Sourced from Publicly Accessible Platforms for Travel Blogger Directory
To enhance the Marketplace and facilitate connections between users and travel content creators, we operate a Travel Blogger Directory. In furtherance of this, we collect limited categories of data pertaining to travel bloggers from publicly accessible platforms, including but not limited to social media sites (e.g., Instagram, YouTube, TikTok, Facebook, Twitter/X), publicly available blogs, and personal websites. This data collection is strictly limited to information manifestly made public by bloggers themselves and is solely for the purpose of populating and maintaining the Travel Blogger Directory, attracting bloggers to the Marketplace as sellers, and enabling users to discover travel content creators.
The categories of personal data sourced from publicly accessible platforms are strictly limited to:
· Public Profile Identifiers: Name, publicly displayed username or handle on social media platforms, publicly visible profile photograph, and a concise, publicly available biography or descriptive text as presented by the blogger on their public profiles.
· Public Social Media Engagement Metrics: Links to publicly accessible social media profiles explicitly designated for professional or promotional purposes, publicly displayed aggregate follower or subscriber counts (as a general indicator of reach, not real-time or precise analytics), and publicly listed contact information specifically provided for business or collaboration inquiries (e.g., publicly advertised professional email address, if any). We explicitly avoid collecting private or non-public contact details.
· Publicly Declared Geographic Origin: Country of origin or primary geographic location only as expressly and publicly declared by the blogger on their public profiles. We do not employ IP address tracking or other means to infer location beyond what is voluntarily and publicly stated by the blogger.
· Broad Content Theme Classifications: General, high-level categories of travel content thematically discernible from the blogger's publicly available content (e.g., "adventure travel," "luxury travel," "sustainable tourism"). These classifications are based on readily apparent themes and are not derived from sensitive or non-public information.
Data collection is performed through a combination of automated web scraping tools and manual curation, strictly limited to publicly accessible portions of online platforms. We implement measures to avoid inadvertently collecting data that is not explicitly intended for public dissemination. We rely on the principle of "manifestly made public" data as the legal basis for this limited processing, recognizing that bloggers, by making this information publicly available, have a reduced expectation of privacy with respect to such data in the context of professional or promotional activities.

- Comprehensive Compliance with Sanctions, Export Control Laws, and Anti-Money Laundering (AML) Regulations: To rigorously ensure full and ongoing compliance with all applicable sanctions, export control laws, and Anti-Money Laundering (AML) regulations, as mandated by U.S. and international law, we may engage in the processing of your personal data for the following essential compliance purposes:

This processing is aimed at detecting and preventing spam, fraud, abusive language, illegal content, and violations of our Terms and Conditions and Community Guidelines.
- Sanctions List Screening and Due Diligence: We process personal data to conduct thorough and continuous screening of users (particularly sellers and, where applicable, buyers engaged in higher-value transactions), transactions, and related activities against comprehensive and regularly updated sanctions lists, restricted parties lists, and other relevant government watchlists issued by the U.S. Office of Foreign Assets Control (OFAC), the U.S. Bureau of Industry and Security (BIS), and other applicable sanctions and export control authorities worldwide. These measures are essential for the lawful and sustainable operation of the Marketplace and for protecting its financial integrity, reputation, and users
3.5. Operation of Travel Blogger Directory and Facilitation of Seller Recruitment
Beyond the general purposes of data processing outlined in Section 3, we specifically utilize data sourced from publicly accessible platforms for the focused purposes of:
· Curating and Operating the Travel Blogger Directory: To create, populate, and maintain a publicly accessible, searchable, and browsable directory of travel bloggers on the Marketplace platform. Legal Basis for Processing Personal Data
We process your personal data based on the following legal bases, depending on the purpose of processing:

This may involve sharing certain data, including user inquiries, support requests, product listing information, and other relevant data, with these AI service providers. This data processing is for purposes such as: automating customer support responses, improving content moderation processes, enhancing product and service listings, and generally optimizing platform operations and user experience. 5. Data Security
5.1. Security Measures
We implement industry-standard security measures to protect your personal data, including:
· Encryption: We use encryption in transit (SSL/TLS) to protect data transmitted between your browser and our servers and encryption at rest (AES-256 or similar) to secure data stored on our systems.

We also perform regular security assessments by internal and external security experts to ensure our systems meet the highest industry standards.
· Data Minimization and Pseudonymization: We are committed to data minimization and strive to collect only the personal data that is necessary for the specified purposes. Where appropriate, we use pseudonymization techniques to process data in a way that it can no longer be attributed to a specific data subject without the use of additional information, thereby reducing the risks associated with data processing.

This right includes access to information about the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipients to whom the personal data have been or will be disclosed, the envisaged period for which the personal data will be stored, and the existence of automated decision-making, including profiling. To exercise this right, please contact us at legal@trekguider.com.
6.2. Right to Rectification
You may request corrections to any inaccurate or incomplete personal data.
6.3. Right to Erasure (Right to be Forgotten)
You have the right to request the erasure of your personal data, and we will comply with such requests, unless there is a legal basis for refusing the erasure. Grounds for erasure include situations where the data is no longer necessary for the purposes for which it was collected, where you have withdrawn your consent (if processing is based on consent), where you object to the processing and there are no overriding legitimate grounds for the processing, or where the personal data has been unlawfully processed. However, this right is not absolute and may be subject to legal obligations, such as data retention requirements, or other legitimate grounds for retaining your data. To request erasure, please contact us at legal@trekguider.com.
6.4. Right to Restrict Processing
Under certain circumstances, you can request that we restrict the processing of your personal data.

You can also withdraw your consent for cookie-based processing through our Cookie Preference Center, accessible via the "Cookie Settings" link in the footer of our website. 6.8. Exercising Your Rights
To exercise any of your rights, please contact us using the details provided in Section 9. We will respond to your request in accordance with applicable data protection laws. Please note that your rights as a data subject are not absolute and may be subject to certain limitations and exceptions under applicable data protection laws.
6.9. Specific Data Subject Rights Pertaining to Travel Blogger Directory Inclusion
If you are a travel blogger whose publicly available data has been collected and incorporated into our Travel Blogger Directory, you are afforded the following specific rights, which are supplementary to and do not supersede the general data subject rights articulated elsewhere in this Section 6:
· Enhanced Right to Access, Review, and Rectify Profile Data: Upon verifying your identity and establishing your association with the relevant social media profiles (typically through a secure social media account linking process solely for verification purposes), you are granted privileged access to review your pre-populated profile page within the Travel Blogger Directory. You possess the unfettered right to rectify any perceived inaccuracies, correct outdated information, or complete any incomplete data fields within your directory profile.
· Unconditional Right to Object to Inclusion and Demand Profile Erasure: You retain the absolute and unconditional right to object to the inclusion of your publicly available data within the Travel Blogger Directory. Upon successful verification of your identity and confirmation of your status as the identified travel blogger, we will, without undue delay, permanently remove your profile from the Travel Blogger Directory and definitively cease any further processing of your publicly sourced data for directory-related purposes. To exercise this right, please direct your request, accompanied by sufficient identifying information for verification, to legal@trekguider.com.
· Exclusive Right to Claim, Manage, and Control Profile Content: Once you affirmatively claim your pre-populated profile page within the Travel Blogger Directory (typically facilitated through secure social media account verification), you are vested with exclusive and comprehensive control over all content displayed on your profile. You may, at your sole discretion and without limitation, edit, modify, augment, enhance, refine, or entirely replace any and all elements of your profile information, ensuring complete user autonomy and granular control over your directory presence. Furthermore, you retain the ongoing option to unilaterally delete your profile entirely from the Travel Blogger Directory at any time, without requiring justification or external authorization.
We are resolutely committed to upholding data transparency and empowering travel bloggers with robust control over their publicly available data as presented within our directory. It is critically important to understand that while we will diligently remove your profile from the TrekGuider Travel Blogger Directory upon a valid request for erasure, this action does not, and cannot, effectuate the removal of your publicly available data from the original third-party social media platforms or websites from which it was initially sourced. The management and modification of your data on those external platforms remain exclusively within your control, governed by the terms of service and privacy policies of those respective third-party platforms.
7. Data Transfers and International Considerations
7.1. International Data Transfers
Personal data may be transferred to and processed in countries outside the European Economic Area (EEA), including to our service providers located in the United States and other countries where our service providers operate. When such transfers occur, we ensure that adequate safeguards—such as Standard Contractual Clauses (SCCs) approved by the European Commission for transfers of personal data to third countries—are in place to protect your data in compliance with applicable laws. You can access the text of the Standard Contractual Clauses and learn more about them on the European Commission's website: https://commission.europa.eu/law/law-topic/data-protection/international-dimension-data-protection/standard-contractual-clauses-scc_en.
